New Delhi: The Delhi High Court on Monday said it would go ahead and hear on merit cricketer Ajay Jadeja's writ petition challenging the five-year ban and rejected Board of Control for Cricket in India (BCCI) and its president Dr A C Muthiah's objection on the maintainability of his plea.[an error occurred while processing this directive]Dismissing BCCI and Muthiah's preliminary objection that a civil writ under Article 226 was not maintainable against the Board because it was not performing any of the state's function but was a society registered under the Societies Act, Justice Mukul Mudgal said, "The preliminary objection raised by respondents to the maintainability of the writ is rejected."When the government lets a body like BCCI assume the prerogative of being a sole representative of India for cricket by permitting it to choose the team for appearance in events like World Cup, then it necessarily imbues the Board with public function... so far as the regulation of the game is concerned," the court said.Fixing November 19 for further direction, Justice Mudgal said, "The question whether the court should interfere in the facts of the present case, is to be decided in light of the tests laid down by the Supreme Court on writ jurisdiction."Jadeja had challenged both imposition of the five-year ban on him from playing cricket for his alleged involvement in match-fixing scandal and the Ministry of Sports' notice to him seeking his reply on why the Arjuna Award conferred on him should not be taken back.
