ICC row: SC lists LG plea on HC order for Jan 31

New Delhi: The Supreme Court on January 24 directed the listing on January 31 a petition by LG challenging the Delhi High Court order which had blocked the release of foreign exchange to the International Cricket Council (ICC), either in form of sponsorship money or as damages by the Board of Control for Cricket in India (BCCI), if India was debarred from playing in the World Cup.

A three-judge Bench headed by Chief Justice V N Khare directed listing of the petition on January 31. LG had challenged the High Court order on the ground that the court had no jurisdiction to entertain the case as the dispute fell squarely on the contractual obligations.

LG in its petition said that as BCCI had "invoked an arbitration clause and the matter is pending before the Swiss Court of Arbitration", the High Court had no jurisdiction to entertain the public interest litigation (PIL) filed by N K P Salve, Kapil Dev and four others.
