Cal HC stays appointment of two additional observers

Kolkata:The Calcutta High Court today stayed the appointment of two additional observers for the BCCI elections here and directed that Suhas Chandra Sen would be the sole observer for the poll.

Hearing a petition filed by the BCCI president Ranvir Singh Mahendra and the Karnataka State Cricket Association, a division bench stayed Justice Soumitra Sen's order yesterday appointing K N Singh and M M Punchi, former CJIs of India, as additional observers.

The bench comprising Justice Pinaki Chandra Ghosh and Justice N C Sil directed that Suhas Chandra Sen, who was appointed by the same judge would be the sole observer for the election and act according to the order of September 21, whereby, he had been appointed as sole observer.

Suhas Chandra Sen is a former Supreme Court judge. Regarding the time and schedule of election, the bench said that the observer would decide on it.

The bench said that a prima facie case has been made out by the petitioner, BCCI president Ranvir Singh Mahendra and the Karnataka Cricket Association.

The bench also observed that Suhas Chandra Sen had not got a chance to perform, yet two additional observers had been subsequently appointed.

It said that yesterday's order of appointing two additional observers could not reflect a correct reason to interfere with the previous order of appointing a sole observer.

There has been no allegation against the sole observer, even then the additional obsrvers were appointed, the bench said.
